Hatch Act Investigations
The Hatch Act limits the political activity of government employees, and its rules are easy to run afoul of without meaning to. An alleged violation can lead to an investigation by the Office of Special Counsel and discipline, including removal and/or debarment from federal service.
We advise and represent federal and state or local government employees on Hatch Act questions, from day-to-day compliance and permissible political activity to responding to OSC investigations and litigating before the Merit Systems Protection Board. We help clients understand the line the law draws and defend them when they are accused of crossing it. This is an area we know from the inside. Before entering private practice, one of our partners led Hatch Act investigations at the U.S. Office of Special Counsel, advised senior officials, and litigated these matters before the MSPB.
